Good for PSNH, bad for property owners

Article 12-a of the New Hampshire Constitution says,”No part of a person’s property shall be taken by eminent domain and transferred, directly or indirectly, to another person if the taking is for the purpose of private development or other private use of the property.

This amendment was passed in 2006 by 85 percent of New Hampshire voters and ratified by 100 percent of the state Senate in response to the infamous Kelo decision by the U.S. Supreme Court, which gave eminent domain power to a private, for-profit company. Americans of every persuasion were rightfully outraged.
